General business terms

1. Introductory provisions

i. These Terms of Business define the relationship between our company FRAGRANCE RED d.o.o. Zagreb, Ljudevita Posavskog 36b, 10000 Zagreb, OIB 08400572569, as a seller and provider of e-commerce services and you, our customer, who enters into a purchase obligation with us.

ii. We apply an identical approach to our customers and provide them with benefits in accordance with the terms of business while making sure to reward customer loyalty. Therefore, the rules established in these Terms of Business will apply to all our customers.

iii. These Terms of Business concern, first of all, the purchase of goods in our e-shop. It will be applied to the same extent to the purchase of goods through the customer service.

2. Conclusion of the sales contract

i. You can enter into a sales contract remotely via e-commerce or our customer service.

ii. When concluding a contract at a distance, just by ordering and sending the order on the website or through the customer service, a sales contract proposal is created. The order will be valid for a period of 7 days, and we will confirm receipt of the order by e-mail or in writing during the conversation. The sales contract will then be completed by confirming the proposal in the form of sending the ordered goods. We will inform you about the delivery of the goods by e-mail or in writing during the conversation.

iii. We deliver the products in the usual quantity for household needs. In specific cases (especially in the case of discounts or sales), we have the right to determine the maximum quantity that we can deliver.

3. Withdrawal from the contract without giving a reason

i. According to the law, you have the right to withdraw from the contract concluded online or by telephone within 14 days of the delivery of the goods, without giving any reason. With us, every customer has the right to withdraw from the contract without giving reasons within 90 days of the delivery of the goods.

ii. If you wish to exercise this right, you must notify us of your decision to withdraw from the contract within the specified time period. The best way is to send the decision to the email info.zagreb@eminy.club or by calling +385 92 404 6792. You can also use the contract withdrawal form on our website.

iii. If you decide to withdraw from the contract, we will pay you the purchase price of the goods. In the event of withdrawal from the contract within 14 days of the delivery of the goods, you are also entitled to a refund of delivery costs in an amount equal to the cheapest delivery method offered. In case of later withdrawal from the contract, we will only refund the purchase price of the goods. The funds mentioned above will be returned without delay, no later than 14 days from the date of withdrawal from the contract. However, in accordance with the law, we can make the payment of the paid funds only after receiving the product. Refunds are made in the same way as when paying for an order, unless the contracting parties agree otherwise.

iv. You should send the products without delay, no later than 14 days from the day of withdrawal from the contract, to the address: FRAGRANCE RED d.o.o. Zagreb, Ljudevita Posavskog 36b, 10000 Zagreb. If the seller, within the framework of the concluded contract, sends the buyer additional goods free of charge (“gift”), this gift must also be returned. In this case, you bear the costs related to the return of the goods.

v. Please note that, according to the law, you are responsible for any reduction in the value of the goods as a result of handling the goods in a manner other than that necessary to familiarize yourself with the nature, characteristics and functions of the goods (for example if you continue to use the perfume after trying it on). Also note that you do not have the right to withdraw from the contract if the goods are damaged by your handling, or if more than a tenth of the product’s contents have been consumed.

4. Complaints

i. If the goods show an error after delivery, the seller can offer a refund or replacement as compensation. You also have the right to request that the error be rectified by replacement or repair. In the event that the replacement of goods with a mistake is not possible or is not acceptable to us, you have the right to a discount on the purchase price, and if the mistake is serious, you can demand withdrawal from the purchase contract. You can also use the above rights in case the error is revealed later.

ii. We assume responsibility for errors in the goods if they appear within two years of the delivery of the goods or before the expiration date stated on the packaging itself.

iii. The goods are considered defective, in particular, if they do not have the usual or described characteristics, if they do not serve their purpose, if they do not meet the legal requirements or if they are not delivered in the agreed quantity. Please note that increased sensitivity or allergic reaction to the delivered goods cannot be considered as faulty goods. Likewise, an error with gifts and other free products that we send outside the scope of your order is not considered an error. Product images in our e-shop are for illustrative purposes only and do not represent a binding representation of the product’s properties (for example, the packaging may differ due to changes by the manufacturer).

iv. We will be happy to answer all questions regarding complaints at info.zagreb@eminy.club or +385 92 404 6792. Send the complained goods to the address of FRAGRANCE RED d.o.o. Zagreb, Ljudevita Posavskog 36b, 10000 Zagreb together with the completed complaint form that you can find on our website. We would like to ask you to indicate in the form what kind of error it is and how it is expressed, as well as your requests regarding the method of handling your complaint.

v. We will inform you about the progress of the complaint itself, especially in connection with receipt, acceptance or rejection, by e-mail or by telephone.

vi. We will make a decision on the complaint without delay. The processing of the complaint, including the removal of the error, will not be longer than the usual 30 days. Otherwise, you will have the right to withdraw from the sales contract. It is necessary to ensure your full cooperation in order to meet the above deadline.

vii. In the case of a justified complaint, we bear the costs related to the return of the goods.

5. Methods of payment and delivery

i. You can choose the method of payment and delivery from among the options we offer. Before sending the order, we will inform you about the chosen method of payment and delivery, as well as about the related costs.

ii. The payment and delivery methods we currently offer, as well as the price, can be found on our website.

iii. The specified delivery times are for informational purposes only and are based on the expected delivery times of the carrier.

iv. In certain cases, we reserve the right to provide delivery of goods free of charge.

6. Miscellaneous

i. We provide various discounts and gifts to our customers. Their use is governed by the rules that we inform the customer about in each individual case. Unless stated otherwise, each discount can be used once. Unless otherwise stated, discounts cannot be combined.

7. Basic information

i. Pursuant to the Law on Sales Records, the seller is obliged to issue an invoice to the buyer.

ii. You can file potential complaints online through the ODR consumer dispute resolution platform. Complaints can be resolved online amicably or out of court.

iii. The contract will be concluded in the Republic of Croatia and will be governed by the laws of the Republic of Croatia.

iv. All prices of products and services are shown with VAT valid at the time of placing the order. In the event that the VAT rate changes before concluding the sales contract or before sending the goods, the buyer is obliged, taking into account the selected payment method, to settle any difference in the purchase price, or the seller will contact the buyer without delay by e-mail asking whether the seller can charge more than the purchase price.

v. By placing an order, you consent to sending the invoice in electronic form. We send the invoice in electronic form together with the order delivery e-mail. If you want to receive the invoice in paper form, let us know and we will send it together with the ordered goods.

vi. All listed prices, including discounted prices, are valid until further notice or while stocks last.
